First if they seek asylum from the first officer they see or nearest police station they are perfectly entitled to go through the Asylum seeking process. US has one of the toughest in the world and has sent many people home who were killed b y mainly drug gangs fuelled by US money from a failed Drug War. It is fair to say that there are people in bigger danger from US fulled drug war than Cuban poor human rights.

Second, unless they are actually found guilty of a law they are not criminals, they are suspects of a crime. Much like Trump is suspect of mishandling documents but is not a criminal unless he is found guilty.

Only Mexican nationals can seek asylum by walking across the border. Anyone from Central America, or one of the hundred or so other countries flooding across the border, are required to seek asylum in the first country the enter upon leaving theirs. in most cases that would be Mexico.

So, anyone from any country other than Mexico can’t seek asylum on US soil if the came in thru Mexico.

Well, in an attempt to explain to you the workings of the Democratic/Liberal/Progressive minds it is like this: You can go up to the border with the US and the very second you cross, you are now a "migrant" seeking asylum and, therefore, in that very instant, you are no longer illegal. It happens instantly, with no delays in time, not even miliseconds. So, there really is not such thing as a migrant crossing the border illegally. Everyone is simply a "migrant" who has not come here illegally.
