Intent doesn't matter in terms of 2nd degree manslaughter. That law covers killing someone accidentally, which appears to be the case here.

What factors in now is not intent, but recklessness. I've read he may have held Neely for as long as 15 minutes in a choke hold. If that's even close to accurate, to me, that's recklessness.
