Our justice system favors the rich and powerful and discriminates against the poor. People shouldn't have to sit in jail or ruin their finances in order to secure their freedom before they've even had a trial proving their guilt. I had a friend who years ago got arrested for a crime he didn't commit. Thankfully, his parents were able to lend him the $5,000 he needed to secure bail and get out of jail before his trial, which was three months away, and which never ended up occurring because the DA dropped the charges the day of. However, the $5,000 was gone, regardless, and he had to pay that money back to his parents. That's not the way our justice system should work.


I have no problem with fixing that problem...... what I don't want is another excuse to allow left wing judges to let violent, repeat gun criminals out of jail even more easily than they already are.

A casual glance through the confidential DSR reveals that virtually every victim of Chicago violence last weekend had gang ties. Either as a member of a gang or those (often young females) who hang out with gang members. The other glaring common thread: the victims themselves usually have criminal histories, too.
In fact, poring over the fifteen pages of incidents (pasted end to end, that’s over 10 feet of incidents), only 21 of the 78 victims did not have a criminal history. Meanwhile, those with arrest records garnered a total of 813 arrests between them.
Eight hundred thirteen arrests.

At the same time, Cook County’s infamous “catch and release” criminal justice system only managed to gain convictions in 120 of those 813 arrests.

Chicago Police commander Paul Bauer was savagely executed, “shot six times in the head, neck, torso, back and wrist.” No fewer than “three civilian witnesses identified Shomari Legghette in a police lineup as the man who struggled with Bauer at the top of a stairwell outside the Thompson Center in the Loop moments before his death” less than a month ago.

Now it turns out that Legghette should have been in prison on any rational basis, but wasn’t because Chicago’s justice system is “a joke” in the eyes of criminals -- in the words of Chicago’s police superintendent.

Greg Re of the Chicago Sun-Times describes how it is that Legghette was free to do what he wished in the streets of Chicago:

The suspect who allegedly gunned down Chicago police Commander Paul Bauer near City Hall earlier this month received an unusually light sentence for major parole violations in 2007, court records show.

The documents, reviewed by the Chicago Sun-Times, reveal that Bauer's accused killer, Shomari Legghette, dodged up to 30 years in prison when he was booked for the violations that year.

At the time of his 2007 sentencing, Legghette was on parole following an armed robbery conviction that landed him a 16-year sentence, and prison time from 1998 to 2005.


Records show that police found Legghette in the South Side in 2007 with $1,800 in cash, body armor, a chrome revolver, and a baggie of heroin, the Sun-Times reported.

But instead of pursuing felony charges for those parole violations, records show, prosecutors opted to send Legghette to prison for only a few weeks after he pled guilty to a lesser charge of possessing a weapon with a defaced serial number.

What Governor Hogan is focusing on is the relatively light sentences that persons convicted of gun crimes receive, many of whom do no time in jail at all.

In any event, Hogan announced that he wants the state legislature to step in and do what the city tried, but failed to accomplish. They need tougher sentencing for gun crimes and those sentences need to mean something. Hogan was quoted as saying, “if you say you’re going to get this number of years, you’re going to get that number of years.” And presumably he means that you’re actually going to do that number of years.

He’s not going to have an easy time of it. Maryland’s Attorney General, Brian Frosh, came out right after Hogan’s remarks and contradicted most of them. He claims to never have agreed to any sort of truth in sentencing law and immediately pivoted to blaming their crime problem on…. Donald Trump.

No.... I am showing actual cities that are being destroyed by judges given too much leeway to allow violent, known, repeat gun offenders back on the street. This means that witnesses and victims have even less reason to cooperate with police because these judges are putting the shooters back in their neighborhoods where they can kill and silence witnesses and victims.

We are dealing with the fact California is going to release criminals without bail. A threat to everyone. That you are in love with crime and perversity so much that you cannot see that is of no importance to anyone other than your parole officer.
 
While this may or may not turn out to be a good thing overall in the long run, one thing it does is it gives judges more power to retain select individuals.
in the old system, you were pretty much guaranteed a way out of jail at least temporarily because in most cases, bail had to be set.

Now, a judge could arbitrarily decide who walks and who stays behind bars. In a system where judges have been shown time and time again to rule or legislate based on political ideology rather than the law, this could spell serious disadvantages for those finding themselves before hard left judges in cases where there is ANY pre-disposition of having some affiliation with any opposition political ideology. The extent to which this sets up certain groups has yet to be seen.

Just pointing it out. Of course, it gives Conservative judges equal power....but proportionally, how many conservative judges are there in liberal California or liberal NJ?

For the most part, I hold actions deemed "great" by liberals and Progressives with contempt.

Public Safety Assessment: A risk tool that promotes safety, equity, and justice - Laura and John Arnold Foundation

Our Public Safety Assessment (PSA) is an effort to help protect communities and make the system fairer. It is a research-based, data-driven pretrial risk assessment tool that provides judges with objective information about the likelihood that a defendant will commit a new crime or will fail to return to court. The tool uses nine factors pulled from the administrative record to produce those two risk scores and flag defendants who pose an elevated risk of committing a violent crime. A team under the direction of two leading researchers in the pretrial field analyzed 750,000 cases from more than 300 jurisdictions to identify the factors that were most predictive of (1) failure to appear, (2) criminal activity, and (3) violence. The PSA does not take into account race, gender, employment status, level of education, or history of substance use. We have publicly released the complete list of PSA factors and the tool’s algorithm. Anyone is able to see how the risk factors are weighted and how the risk scores are calculated.
