Nope--to obtain a FISA warrant--the investigation has usually started FIRST--and then they run into the Judge to have a FISA warrant issued. Meaning there was probable cause for the warrant. The FISA was revised after 9/11. Meaning terrorists could be followed their phones tapped etc. to look for information, and once found then they could obtain a FISA warrant after the fact. You can't get any kind of a warrant without probable cause. You have to convince a judge of probable cause. Nope--to obtain a FISA warrant--the investigation has usually started FIRST--and then they run into the Judge to have a FISA warrant issued. Meaning there was probable cause for the warrant. The FISA was revised after 9/11. Meaning terrorists could be followed their phones tapped etc. to look for information, and once found then they could obtain a FISA warrant after the fact. You can't get any kind of a warrant without probable cause. You have to convince a judge of probable cause.
