DACA Upheld by Supreme Court

It wasn't actually upheld. It was ruled that the administration went about ending it in the wrong way.

How can someone incorrectly go about ending an In-Constitutional Law that was created by a self-professed 'Constitutional scholar' declaring he had no Constitutional authority to affect US Immigration Law by-passing Congress - the only ones Constitutionally allied to write / pass laws - to impose a personal edict as law?

How can you improperly expunge a NON-law?

Roberts just ruled that an Un-Constitutional law Un-Constitutionally created can remain a law until it is 'properly' rescinded...

Great news - Roberts just set the precedence for the Executive Branch (Presidents) to by-pass Congress and impose their own laws through personal edict / Executive Order.

It WAS Obama. I have posted the link many times. For once the food is - who violated the Constitution on several occasions was right.

The Constitution's Separation of Powers clearly states it is CONGRESS and ONLY Congress that authors legislation and votes bills into the law.

Laws are not created by issuing Executive Orders, by-passing Congress altogether.

Roberts is not f*ing blind or stupid to this.

DACA was, therefore, never a Constitutional law.

Since DACA was an Executive Order any President after 'Ears' has the authority to rescind the order through on of their own.

Again, the precedence Roberts just set was to allow US Presidents to bypass Congress to create their own laws through Executive Order ... Changing the Constitution himself.

“He dislikes decisions that alter precedent, invalidate federal statutes, sweep too broadly or (as here) upset settled expectations or cause administrative disruptions. This is also a sufficient priority for him that his concern for disruption will trump his concern for adhering to statutory text or constitutional principle,” Adler wrote.

Well, it’s fair to ask, if a chief justice of the Supreme Court allows his distaste for upsetting “settled expectations” to outweigh “statutory text or constitutional principle,” then why do we have a Supreme Court at all?

By saying Trump cannot undo a previous administrations EO with his own EO, this effectively binds Presidents by previous Presidents EO's, (if the SCOTUS likes the prior EO, apparently)

After consideration of the language of Article V, case law, historical practice, and other factors, this paper concludes that Congress should add existing plenary applications to the BBA total, and that it should call a BBA convention if and when the aggregated total reaches 34.


So if Trump has a landslide win and the GOP regains the House, maintains the Senate and picks up a majority in a state that has not yet called for an article Five Convention, only one more state is needed to call the convention if a sympathetic Republican House rules in favor of aggregating the BBA applications with the 'plenary' 'blank check' applications and have an instant super majority of states in favor.

So next year could be the beginning of addressing a huge number of egregious SCOTUS rulling, two of which have come in the last two weeks alone.

No she can't; they've invented a legal system determined by Federal judges' whims and fiat, i.e. a kangarro court system, sinc ethey can't win by legal means, they do so by judicial appointments; need to unilaterally strike down amendments like Prop 8 in California? Mkae sure you have appointed some mentally ill homo judges to Federal benches you can count on, and have a corrupt AG like Eric Holder in charge of Federal law enforcement.

The Supreme Court specifically said that it wasn't settled.

We'll see; they seem to be willing to keep kciking it down the raod on flimsy pretexts, when it's clearly illegal to even be funding it. They might be trying to avoid making it an election year issue, but given the GOP establishment's past history of enthusiastic support for criminal illegal aliens, I wouldn't count on that being the case.
