What they think they can prove. Correct. But insurrection is more of a group charge. So yeah, it was never likely that any individuals would be charged with insurrection. Even though some of them acted in a way that definitely meets the letter of the law. The riot was unorganized with 1000 people with 1000 fantasies and degrees of intent.

Everybody in that crowd, that entered the Capitol should be charged with a felony. There is no scenario in which their entry, the way they entered, or any degree of intent, excludes them of felony breaking and entering. It doesn't matter if you were the one that broke the window, or kicked in the door, you are equally guilty. Even if suspended prison is given, the felony on the record, which excludes them from being able to vote, or possess a gun, is the only correct verdict in any of their cases.

I tend to agree, because a strong message must be sent. If this happens again, many more people are going to get hurt or killed.
 
Haha sure. One dead traitor in the ground, no murder charges, only awards for service. I.E., reality. Bang that head against the wall.
