It’s a lawsuit. The plaintiffs sued to have Trump removed from the ballot on the grounds that he engaged in insurrection and therefore was not eligible to run per section 3 of the 14th amd.

Lawsuits are heard in civil court. There was a civil trial held. Evidence was presented and Trump’s lawyers countered. The judge ruled that Trump indeed engaged in insurrection and that he should not be on the ballot.

Trump’s team appealed to the district court.
That court upheld that Trump indeed engaged in insurrection but that he was not disqualified under the 14th amd.

Finally it was appealed to the CO SC where they upheld that Trump engaged in insurrection and that the 14th did apply in this case. They agreed that Trump was ineligible to be on the ballot.

For SCOTUS to rule against this they will have to go against multiple courts and multiple judges who have found Trump to have engaged in insurrection. Or they will have to find fault with the 14th amd findings. Neither is likely.

The spirit of the law is to keep those who engaged in insurrection or rebellion while serving in elected office from serving in the future. Confederates or otherwise.

The next steps need to be suits against members of Congress who participated as well.

Defendants are found LIABLE in civil trials and monetary awards are declared. Civil trial defendants are not found GUILTY of ANY crime. You're welcome, glad I could enlighten you.

I never said or implied anyone was found guilty of insurrection. I never said or implied that a criminal conviction was necessary at all.

Those are flaws in your thinking.
