Hawaii has decriminalized marijuana

Hawaii on Tuesday decriminalized marijuana, making it the 26th state to decriminalize or legalize the drug.
The new law removes the possibility of jail time as a penalty for up to three grams of marijuana, but maintains a $130 fine. Hawaii’s Democrat-controlled legislature approved the bill and sent it to Democratic Gov. David Ige in May. Ige didn’t sign it, but he also didn’t veto it, effectively letting it become law on Tuesday. The new law will take effect on January 11, 2020.

I guess "fuck the constitution" too huh? That's what says that state law cannot usurp federal.

What part of the Constitution allows the federal government to ban marijuana?

The part that says federal law overrides state. And pot is illegal according to federal law.

It's known as the "supremacy clause."

State constitutions and state laws are subordinate to federal law.

Marijuana is illegal under federal law even in states that legalize it

States cannot pass laws legalizing pot and they cannot pass laws legalizing anything that's illegal according to federal law, such as child porn. Not that pot and porn are related, but both are banned by federal law and no state law can change that.

There are only two options from here on out: Rule all state laws making pot legal as unconstitutional and illegal laws and thus unenforceable or change federal laws regarding pot. If they do that, then they are all in the clear. But sans that decision, pot is still illegal and you can be arrested for possessing it anywhere in the USA.

Once AGAIN ---- there is no such thing as a law that "legalizes" something. Laws ILlegalize.

Is there a law that says you may drink water? No, because it's not necessary.
