What Trump did wasnt a crime before and isnt a crime currently.

The only statute cited in the indictment is 175.10 falsification of records.

The "another crime" is not specified.

Merchan said they did not have to specify which "another crime" the charges relate to, and the "another crime" does not have to be committed by the person who is charged with 175.10.

The "another crime" can be:
Cohen's excessive campaign contribution (FECA)
Violation of NY Tax Law 1801 (a)(3) or 1802 (which are misdemeanors)
Violation of NY Election Law 17-152 (also a misdemeanor)

The prosecution is barred from offering any other crime in support of the felony enhancement of 175.05 (misdemeanor falsification of records).

That is the ruling from Merchan in the "Decision and Order" from February 2024.
