The initial intent as expressed by the constitution was that the legislative branch enact the laws and the judicial branch INTERPRET them - the function of SCOTUS is to interpret the constitution - not rewrite it to suit their political persuasion. Sadly this has been the case - SCOTUS for a very long time has been rewriting the constitution and one its failures is that the constitution provides no real method of keeping them in check - the hypothetical 3 way balance of power Executive - legislative and judicial is a failure.
