The data says it is a fact. They proved that. The judge ignored it.
#1 No the data doesn't show that. The data shows the time interval between "clicks". The data does not show whether it is impossible to compare for consistency signatures on a computer screen in under 3 seconds. (Something, which once you get into a rhythm can be done.)
#2 You know that the chart the expert used was NOT admitted to the case record as evidence, right? There was no foundation to the data presented, the data was not verified, and therefore the exhibit was not admitted.
