Setting a high price for a luxury property is not a "lie". That is business as usual. The entire case against Trump is a ridiculous application "the law". James and Engoron should be disbarred. You hate Trump and love Stewart so you pick and choose who was right or wrong based on that.

To say your asset is worth X amount in value, because you can raise rental rates each year... thus income each year, making the property quite valuable on the market to a buyer... is expected and a common way to say your estimated property value is higher than what it may appear this moment in time... And things like that, which borrowers use as a way to increase their assets... so to lower their loan risk in the bank's eyes.

But, the Trump org did fraudulent things to claim their assets were higher...using the example above, the Trump org on a few properties that had lots of rental income, coming in, where he claimed its value was much higher due to the rise in future rental income,

were RENT CONTROL buildings.... Where their building value and Trump's asset, was worth much LESS than he claimed when he lied on the form saying those buildings he owned were not under RENT CONTROL.

THEN the Trump org lied about Trump's penthouse home, claiming its asset value in the 1000% over the market value of it, by claiming his 10,000 sq foot penthouse was 30,000 feet.

These, fraudulent type claims and over valuing his assets over the statutory 10 year period, were repeated over and over again, changing lies even, over the period.

These were INTENTIONAL fraudulent claims....not just an opinion of market value that could be subjective. Trump org, put down outright made up lies over and over and over again similar to the ones listed above...

Yes.....and his actions pull the covers off of one of NY states most oft repeated real estate practice. ....legal or not.....this is SOP for the big transactions. NY state is not alone.

Trump said his property was valued at between $300-400 million......and many Real Estate professionals say they could sell it for that.
Engeron claims a property he claims is only worth $18 million, that is bigger than all the properties that are on both sides of Mar-a-lago which are valued at $100-150 million, is only worth a fraction of that.

It doesn't matter if Jon Stewart was trying to build another property or he was selling his own home. The issue that they charged Trump with is exactly the same. Overvaluing his own property. There's no laws on the books that says you can't do this.

Also, you can sell your property for whatever price you want. Be it $1 or $1 million. It doesn't matter what the appraiser says your property is worth as long as there is a buyer willing to pay what your asking price is.

It's when you buy a property and then sell it within a short period of time for more than you paid for it. If you buy a property from a motivated seller you can usually get a bargain on the purchase price. Then turn around and sell it 6 months later. You can also game the market and sell it when the price goes up do to it being a seller's market. My wife bought her home for $37,500.00 and sold it for $427,000.00 several years later.

This practice was wide spread for the 15 years leading up to the great derivatives crash of 2008....it was happening everywhere.
 
Nope! One can lie, brag etc all they want about their own home value in the public. One can also sell their property for what a buyer is willing to pay, as long as the seller reveals all known problems to the buyer.

The core issue is lying on a certified to be true financial asset form listing the borrower's property assets, that is required when borrowing money in the multi-million dollar range, to determine the customer risk and rate of interest.
