If Hillary Clinton is innocent of any wrong-doing, at least in the minds of the media and extremely partisan Hillary supporters, it is because both groups completely ignore the actual Laws that apply to her scandal.

Justice Department veteran Ronald J. Sievert pointed out in an article in Newsweek this week the actual laws the media (and citizens) should be focused on and talking about regarding Hillary's case but Laws that are being ignored...because they inconveniently point out the criminal violations of those laws.
1. 'Marked Classified or Not & When': Too much emphasis has been placed on these questions...and the truth is they don't completely matter:
18 USC 793
'The applicable statute, 18 USC 793, however, does not even once mention the word “classified.” The focus is on “information respecting the national defense” that potentially “could be used to the injury of the United States or to the advantage of any foreign nation.” 793 (f) specifically makes it a crime for anyone “entrusted with … any document … or information relating to the national defense … through gross negligence (to permit) the same to be removed from its proper place of custody.”
-- Hillary's server, which was inadequately and improperly encrypted & which contained over a thousand pieces of classified documents / e-mails / pieces of information - some marked as such and some classified after being found, was found in the BATHROOM of a small IT company whose employees did NOT have the legal security clearance required to store and maintain the server. After leaving the State Department, as well, Hillary Clinton - by law - was supposed to have NO classified information / products in her possession at all! She had tons of it. Although not 'classified' a the time the information 'that potentially “could be used to the injury of the United States or to the advantage of any foreign nation.”
IF THIS IS NOT AT LEAST 'GROSS NEGLIGENCE' THEN THERE IS NO SUCH THING.

"Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—"
Let's break that down:
1. 'REMOVED FROM IT'S PROPER PLACE OF CUSTODY'
Hillary violated administration rules regarding using official e-mail. She warned her own State Dept employees they should use official e-mail...then she deliberately chose to NOT do so herself...to avoid having to comply with Federal Law, specifically the FOIA. (The Obama administration has set a US Record for failing to comply with FOIA requests a total of 70% of the time.)
Libs / Hillary says she had approval to have her own server...but not to hide her server, until it got exposed, not to have classified information of any type after leaving the State Department, not to violate FOIA requests by hiding correspondence and intel, and not to destroy classified - which she tried to do. (The State Department - already proven in a link - even came out and stated Hillary had NOT turned over all State Department-related intel / e-mails.)
2. 'DELIVERED TO ANYONE IN VIOLATION OF HIS / HER TRUST':
It is now known Hillary e-mails classified information to those without the adequate security clearance to have access to the material sent. Her server was entrusted to an IT company that did not have the legal security clearance to handle / store / maintain the extremely classified server / material on the server. Finally, her own aides have testified Hillary told them more than one to strip the security markings off of the documents and to send them via un-classified means for expediency.
3. 'DESTROYED'
Hillary tried to wipe her server and destroy classified material. Like with everything in the government there is a rule / law for everything, such as the proper destruction of classified material...which Hillary violated. Much to her displeasure the FBI recovered much, if not all, of what she tried to destroy.
4. 'HAVING KNOWLEDGE'
'Someone' had access to Hillary's e-mail, had access to Hillary's server, had access to Hillary's username, had access to Hillary's password, placed all that classified information on her server, AND wrote all those e-mails using her identity in which they sent all that classified ... and, according to Hillary / libs, IT WASN'T HER. REALLY?!
According to her, it was that same kind of cluelessness about what was going on in the Agency she was responsible for running that got 4 Americans needlessly killed in Benghazi. I know Hillary's staff has claimed she 'often gets confused' and is 'technology challenged', so it is SLIGHTLY possible that someone stole her username/password, was pretending to be her using her e-mail, and loaded all this extremely classified information on her server without her knowing it...BUT D@MN, DO WE REALLY WANT SOMEONE THAT INCOMPETENT / STUPID / CLUELESS RUNNING THE COUNTRY? Actually, it is not humanly possible.....even for Hillary.
5. (FINALLY) 'FAILS TO REPORT':
Hillary set up the server to avoid FOIA requests and hide her actions. She initially DENIED she had her own cell phone, DENIED she was using SEVERAL devices, DENIED she had her own e-mail, & DENIED she had her own server. She was FORCED to come clean and report everything. The State Department has already said Hillary did NOT come forward and give them all of her State Department .
None of this has been hidden. The law is not one that has been kept secret / hidden...but it is one that the media and liberals have completely IGNORED.
