Here in the United States at large, there is no “right to abortion” nor any “right to privacy.”

BTW. A cursory reading of the Act in question makes no mention of abortion, only women in labor, stabilizing a situation (and the child's safety).

Hardly, the DOJ is attempting to misuse the law. Baby killing is not an emergency, there is no place to apply supremacy.
The DOJ is enforcing Federal law over state forced birth legislation in Idaho.

Under the Idaho law, which is set to take effect on August 25, abortion providers could be subject to arrest and prosecution if a prosecutor can show that an abortion has been performed, with the burden placed on providers to prove an "affirmative defense" at trial, according to the DOJ.

The law "places medical professionals in an impossible situation, they must either withhold stabilizing treatment required by EMTALA or risk felony prosecution and license revocation. In so doing, the law will chill providers' willingness to perform abortions in emergency situations,"

That's an opinion, not a legitimate reason to file a federal lawsuit. If there is an actual emergency the evidence will be obvious and abundant.
