I think that was an option for him but I guess he decided to ask them first. He may have tried to threaten them with the subpoena. But they refused and acted like they were going to fight it. I can't blame them because the lawyers knew that this would have been a game changer. So in the end it was either take it to the supreme court or come to a compromise.

Mueller laid out in the report those actions by Trump himself & by Trump's instructions to subordinates, that demonstrate Trump was active in his attempts to circumvent Mueller's function as SC. There is no debating those facts. Thus Mueller's statement, "The evidence we obtained about the president's actions and intent presents difficult issues that prevent us from conclusively determining that no criminal conduct occurred."
That statement has real potential to be both politically & legally damning for Trump.

Mueller wasn't clear about anything except NO Obstruction. Everything else is only clear about one thing: he truly hated Trump but not for the causes with which he was supposed to zero in on in his "investigation." His investigation was to look into Russian collusion and Russian collusion only. If he ventured down other avenues, it becomes politicial espionage--in other words, using the FBI to beat up the opposition party's anathema with character assassinations on other counts than what his mission was--to find about whether President Trump colluded with the Russian government or acted as a spy. Anybody using the government FBI agents to spy on an adversary is committing a felony.
