The U.S. Constitution, Article II, Section 2, Paragraph 3 (last para in section 2):

The President shall have power to fill up all VACANCIES THAT MAY HAPPEN DURING THE RECESS OF THE SENATE, by granting commissions which will expire at the end of their next session.

Now, would someone please show me where the President has the power to make recess appointments except when the vacancy occurs during a recess of the Senate? Much less an appointment to fill a vacancy that occurred while the Senate was in session, and make that appointment while the Senate is in session?

Actually, I'm still waiting for someone, anyone, to show me where in the Constitution the President is granted power to issue Executive Orders other than those required in the performance of his Duty to 'execute' the Laws passed by Congress and signed into Law by Himself?

if the legislature or president act unconstitutionally, that would be something for the court to rule on. presidents don't get tossed from office for doing things the far right doesn't agree with (or the far left for that matter).
