The constitution gives congress that power. So what's the problem. It's promulgating equal protection. Where you have the same basic voting rights in every state for a federal election. States are still free to set whatever rules they want for local elections, including completely eliminating them.

The funny thing is how Scalia managed to interpret the 2nd amendment different than how a 5th grader would.
A 5th grader using the rules of english, and not where "the people" has at least three different meanings.

The constitution says the state legislatures will run elections, not Congress.
