There has been no such determination that the crime of insurrection occurred let alone who committed it. I referenced the 14th to illustrate that enforcement is clearly the purview of the US congress--not the states. The democrat partisan theater is Nothing Burger.

What do you imagine due process to be because you keep using those words and I don't think you fully understand them. You don't have to be convicted in criminal court to be found liable in civil court do you? That's because in a civil trial you have due process as well. Just as Trump had due process in the hearing to determine if he committed an act of insurrection after taking an oath to protect the constitution that ultimately found him disqualified from the ballot.

How is the 14th different than the rest of the constitution that doesn't require a conviction. When they wrote the 14th they knew insurrection was a crime, yet the people it was actually intended for were Jefferson Davis and Robert E. Lee.
And neither of them were ever charged or convicted. So if conviction was required, they could have run for president.

The whole goal of the 14th, wouldn't have stopped the people it was intended to keep out of office.

Or, the conviction requirement is wrong. I'll go with the second.
