The issue was interesting in that it highlited the difference between Gorsuch's textualism and Kavenaugh's original intent. For Kavenaugh there'd have to be a const amendment to extend equal protection to gays. For Gorsuch, you read the law, interpret literally as the words were viewed when they were written, and apply it.
