I think your argument is interesting and your point is well taken but it's a false comparison. A doctor treats people individually whereas a person with a gun can have multiple victims.

In my case two surgeons screwed up my hip replacement. And I got a bonus back surgery added to the mix.
The first left my repaired leg an inch longer than my right. I asked him point blank if this wasnt going to cause back problems later on.
Of course he insisted it would be fine......fast forward two years and had to get my 2nd and 3rd vertebrae fused. All was well for about eighteen months,then the pain was back. Had two different surgeons look at an MRI of my back and could find nothing wrong.
Off to a specialist that repairs botched hip jobs.
He had no doubts that my pain was caused by the botched hip replacement. So in he goes and he just replaces the ball/femur portion,because the socket was well set. The risk in doing so was hip dislocation...which happened twice before he said they were going to have to go back in and replace the socket as well.
I'm getting close to ditching the walker and my pain is gone so here's to hoping.

So all and all a terrible experience.
One hip replacement led to three hip replacements and a back surgery.

It's the first time in my life I considered suing.

Yes, it is. People can shop around based on the reputation of the doctor and their success and failure rates. People have a CHOICE. That's the difference.

A lawsuit may be meaningless but it sets the precedence of doctor error which was the point I was intending to make.
