Slavery was legal in the United States before the Civil War, during the Civil War and for almost a year after the Civil War.

The issue of slavery was a political one.

The Republicans in those days were the filthy ass Liberals and mostly came from the Northern states. They controlled the Federal government because they had the greater numbers. They were using the power of the Federal government to steal from cash rich Southern states. Not much different than what the filthy Liberals are doing nowadays.

The question of slavery had to do with the expansion into the West. If a new state in the West was to be a slave state then it would be dominated by Conservative Democrats. If it was to be a non slave state then it would be dominated by the Liberal Republicans. The question of slavery that had been debated was really to limit the political power of the opposing party.

Lincoln did not run on a platform to stop slavery in the US but to stop the expansion of slavery into the West that would expand the power of the Republican Party giving more power to the Federal government. More Republicans in Congress meant more thievery of the government to the people of the South that had money coming in from exports. Back then most of the money raised by the Federal government was from tariffs. We are talking about redistribution of wealth and the South was going fucked because of it. Just like the Liberal thievery we see nowadays.

That is why the South seceded. To keep from the Liberal fucking them.

By the way, my great great great grandfather served in the Confederate Army. He wrote 168 letters that gave his reason for joining and a chronicle of his service. We have donated those letters to the University of Florida Library and you can go read them if you want. He says very clearly in the letters that the reason he joined was to fight against an invasion by the Yankee scumbags.

His first battle was at Olustee in Northern Florida where the Union assholes had invaded and were killing Floridians and burning down their homes and destroying their crops. The Union shitheads were slaughtered,mainly because most of them were worthless Negroes from the 54th Mass Colored Regiment. Great victory for the good guys.

but most soldiers in the south did not own slaves

And some northern leaders did own slaves
