The court found that CONGRESS should have the say on whether someone was an insurrectionist. it did not address the issue of whether or not Jan 6 was an insurrection.

That question wasn’t in front of the court so no surprising they didn’t weigh it. SCOTUS isn’t a criminal court so…. If anyone anywhere had a scintilla of evidence showing Trump participated in an insurrection he’d have been charged already.
