The Supreme Court decides what measures are Constitutional and what measures are not, authorized by the doctrine of judicial review (See Marbury v. Madison (1803)), and Articles III and VI of the Constitution.
Moreover, acts of Congress are presumed to be Constitutional until, again, the Supreme Court rules otherwise. (See, e.g., US v. Morrison (2000))
