The case has already been made, Flynn already pled guilty before the court and the matter is in the sentencing phase, which is up to the judge. Not clear what could prevent the judge from rejecting the DOJ motion and just proceeding with sentencing.

The Judge is going to go along with the DOJ. The case will be dismissed on the basis of new evidence.

Stop talking out of your ass, DOJ motion for dismissal is not based on any new evidence. It is based on rationalizing Flynn's lying as not material to FBI's investigation. But judge Sullivan has ALREADY found that Flynn's lying was in fact material.

This judge simply going along with DOJ's motion is unlikely.
