Because then they would have gotten into a pissing contest with the family, who would complain to Congress that their son was a POW, and the Army was listing him as a criminal, and oh, yeah, here's the e-mail from our son detailing some of the atrocities his unit was committing, like that kid they ran over.

Obama may also be guilty of treason by releasing known enemy assets back to the enemy. That constitutes giving "comfort" to the enemy during an ongoing conflict. I know, I know, you'll suggest that there needs to be "intent that such comfort be used by or for the enemy." But I contend that intent not be needed for this to be treason. By making a deal with the enemy, by giving them 5 of their most dangerous members during a time of war, you have committed treason.

the problem here is that all these guys we are holding at Gitmo, especially the Taliban, we are holding in violation of the Geneva Conventions.

Also, we are not releasing them "back to the enemy". We are sending them to Qatar, a neutral power which is brokering a peace treaty.

Well, reality check.

If we had a legitimate crime we could have charged these guys with, we'd have done it when we caught them in 2002.

If we had an Afghan government that could prosecute them legitimately, we'd have turned them over to them. Of course, Bush's best buddy Karzai threatens to throw in with the Taliban every time we make a decision he doesn't like.

There was probably a point where Afghanistan was winnable, and that was in 2002, when we just overthrew the Taliban and a lot of average Afghans were disillusioned about how badly they ran the country.

Sadly, Bush decided to send all the troops to Iraq to avenge his pappy!

So after a decade of neglect and incompetence, most Afghans would probably welcome a return of the Taliban at this point. In any event, no peace deal is possible without them.
