This has not yet been decided, and Menendez is still planning to run as an independent in the upcoming election (regardless if he's in prison or not). The decision on expulsion votes or hearings is up to the Majority Leader or the Senate Select Committee on Ethics.

Both the request to resign AND the forced removal happened well before Santos is even on trial for anything.
