How sad will gays be if every state becomes that and they cannot obtain a marriage license?

Even in common law states (of which IIRC there are only a couple) they can use the same common laws to establish a legal civil marriage.

So what is the difference?

In the vast majority of States there is no Common Law Civil Marriage anymore (Common Law Marriage by State), so getting a Civil Marriage can only be accomplished with a Civil Marriage licenses.

They can already get a Common Law Civil Marriage in any state that has it. But as pointed out before, the vast majority of States don't have Common Law Civil Marriage anymore. The only way to get Civilly Married is via a Marriage License.

Seems that you are trying to make a distinction between Civil Marriage entered into via a Civil Marriage License and one entered into via a Common Law Marriage. There isn't.
