Yep. Nowhere does the Constitution give the Administrative branch the authority to create laws. Yet, that's exactly what it does when it creates new regulations. Congress should have to vote on every line of every new regulation.

No. Public opinion certainly brought the issue to the courts, but it didn't become law until the courts ruled on the issue. Gay marriage wasn't legalized just because people wanted it.
