The term "sanctuary" is broadly applied to jurisdictions limiting their cooperation with federal immigration authorities. There is no statue requiring local and state governments to enforce immigration law or to aid the federal goverment in anyway other compliance with following statue.

The only statue that puts any requirement on state or local government is 8 US Code 1373 which prohibits any state or local government or official from prohibiting or in any way restricting, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual. However, there is no requirement that local or state government provide any assistance to INS other providing the requested information on immigration status and citizenship. Furthermore their is no requirement that state and local government maintain the above information nor is there a time limit on replying.

The idea that state and local governments are obliged to enforce immigration law or render any assistance other than providing the requested citizen and immigration status is not true.

Few if any local or state agencies could be ruled in violation of the law. Any cooperation beyond this statue is purely voluntary.

1.) The Supremacy Clause establishes the U.S. Constitution as the highest law in the land.

2.) The U.S. Constitution also establishes the federal government as responsible for immigration.

3.) The U.S. Constitution also establishes that federal law trumps state & local law.
