The fact is that there are still no evidentiary hearings held in a court of law that you can point to. Were there some sloppy pleadings? Yes. We’re there maybe other procedural impediments? Maybe. But it doesn’t much matter now. The result is the same. No evidentiary court hearings addressing the evidence (or the lack of evidence).

Like any other criminal case, you find evidence of the crime, you investigate it, if you find cooberating evidence you get a warrant to obtain the records. If there is a secrecy problem the court sets the standards on what can be disclosed. Follow the damn law... that's what it's there for.
