Quite obviously, there are differing levels of Constitutional knowledge and adherence on the court. It should not really be that difficult to decide, for example, if obamadon'tcare's individual mandate is a tax or a fee, and based on that, whether it is Constitutional for the government to force citizens to buy a product. It is obvious that picks for the SC have not recently been totally based on Constitutional knowledge and judicial temperament. Remember the statue of Lady Justice? She is supposed to represent the judicial ideal, and she wears a blindfold. The court is not supposed to "represent" grievance groups, it is supposed to dispassionately weigh laws against the Constitution.The SC does not "represent" anyone, it weighs laws against the Constitution.
Forgot to ask......Why are then soooooo many 5-4 decisions by the SCOTUS?
