  • Federal law already prohibits any persons from possessing or receiving a firearm if they are unlawfully in the United States.
  • NICS is not, however, currently required to notify immigration authorities if an applicant is in the country illegally.
  • Since November 30, 1998, NICS has issued denials for 36,189 attempted firearm purchases by illegal aliens.
  • Over the 15-month period from January 1, 2020 to March 31, 2021 NICS issued denials for 7,373 attempted purchases by illegal aliens.

That is very nice, but not all non-citizens in the US are here unlawfully. Those that are here legally are able to buy a gun

It only applies to American citizens. Who else are rights reserved for?

That law forbids illegal aliens...sure.....but the question was about the Constitution protections....it protects all under it's jurisdiction. Even citizens can be forbidden from having guns.

Moreover, that law says nothing about legal aliens....such as the folks ship to MV...they are here legally at this point, thus that law doesn't forbid them from purchasing a firearm.
