Good point. Roe v Wade was a SCOTUS OPINION that Congress elected to regard as law.
There's only three ways to reverse it:

1. Congress specifically writes a law governing abortion which they have no Constitutional authority to do.

2. SCOTUS reverses itself and that reversal is regarded as law.

3. Stop giving the courts authority to change or write any law and state that only Congress can make laws that affect the people of the land. Which is what the Constitution specifies.

The FEAR of the abortion industrial complex is that a case such as the challenge to Georgia will cause a more law abiding court to vacate the patently illegal Roe ruling. I don't think Kavanaugh has the moral fortitude. We know that Roberts will stand with abortion. If Ginsburg kicks the bucket that could make it a draw, IF Kavanuagh supports the Constitution. Roberts and the other liberals against the 4 conservatives.

The issue with abortion should be with the states period. The U.S. Constitution gives no authority of any sort to the U.S. government to dictate social policy of any kind.

And I trust the American people to step up and settle on a humane, sensible, practical, ethical, moral policy on abortion which would not include a complete ban anywhere--the more draconian state laws re abortion are not likely to endure for long because I think the people will demand a more balanced approach. But even if they do, the vast majority of states won't adopt so restrictive a policy. But many will put reasonable restrictions on abortion on demand because that is where the majority of Americans are on the issue.

So even if SCOTUS eventually does rule that the language of Roe V Wade is reasonable, but the decision for abortion laws belongs with the states, I think the vast majority of Republicans and all reasonable Democrats will be satisfied with that ruling.

And then maybe Congress will shut up about it and get back to the business they should be doing. We can only hope.

The reason President Trump was elected, despite all the personal baggage, is because he convinced us that he was not that kind of candidate. He presented a vision we could embrace on at least most fronts, and convinced us that he was neither partisan nor professional politician nor member of the permanent political class and he would do his very best to achieve that vision.

Democrats have been accusing Republicans of wanting to repeal Roe v Wade for decades now and indeed a few Republicans here and there express their intention to do that, but it hasn't happened yet. And I don't see that the landscape for Republicans will have changed that much by next year either.

Abortion was never declared a constitutional right. Roe v Wade didn't do it.

The right to privacy is not in the constitution. SCOTUS declared the right to privacy is a penumbral right flowing from constitutional rights already granted. Abortion was held to be a private decision between a woman and her doctor thereby receiving constitutional protection. This can be challenged many ways.

Yeah, I always tell my hyperbolic lefty friends, they have nothing to worry about if any of these State laws go before the SCOTUS. I remind them that it was a conservative SCOTUS that gave us Roe V. Wade, and it is the conservatives that protect individual liberties and rights to begin with.

THANK THEM for the civil rights era and the protection of the bill of rights. Not the left which always rules in favor of the government and the corporations.


The right to privacy came from the right. States rights and individual liberties are always protected by CONSERVATIVE jurors.
