Judge Roy Moore defies feds: 'Law is very clear'

I have many times brainiac
14th amendment
14th Amendment doesn't apply. Only the 9th anf 10th Amendments.

Romer v. Evans already found that the withholding rights from gays is a violation of the equal protection clause of the 14th amendment. 15 years ago.
Not when it comes to marriage specifically.

Why would marriage be any different than any other right? You keep making up these imaginary exclusions, caveats and restrictions that are complete bullshit.

You started by insisting that 14th amendment only applied to issues of race and citizenship. That was bullshit.

You then insisted that the 14th amendment doesn't apply to gays. That was bullshit.

And now you're insisting that the 14th amendment doesn't apply to marriage. The courts already applied it to marriage. So bullshit cubed.

Damn. If you'd been offering us answers at random the law of averages would have mandated you get something right by now. But astonishingly, you've managed to be perfectly wrong.
Equal protection my ass then why isn't group marriages legal? Why isn't polygamy legal? your argument doesn't hold water.

If you want group marriage, make your argument before the court. The issue they're ruling on now is gay marriage. And there's no valid reason to exclude gays. As the gender restrictions serve no valid legislative ends, no legitimate state interest or even have a good reason.

And a State needs all three. Which might explain the near perfect record of failure in gay marriage bans.

Doesn't matter - you cannot vote away another person's civil rights.
Marriage is not a civil right.
Equal protection of the laws is. Married gays want the same government cash and prizes awarded to married couples by law.

That is all this is about.
And they canhave them! All they have to do is marry somone one of the opposite sex. Just like straight people!
As Loving V. Virginia made clear, the restriction to marriage itself has to meet constitutional muster. IT has to have serve a valid legislative end, serve a legitimate state interest and have a very good reason.

Gay marriage bans fail all three.
It's the state's interest to protect children from viewing the depravity of homo's in public.

That is unfair to single people therefore marriage is a violation of the 14th amendment.

Ok, then get the gov't out of the marriage business completely. That has been my preference all along.

Yeah, that's not actually a thing. Nor has any State ever argued it in court, nor has the court accepted it as a valid legal argument.

Because no other group is afforded group marriages or polygamy. That is the point. When you single out one group and deny them protection that is afforded everyone else, and you have no valid reason for doing so, the feds step in and correct the problem.
I repeat Marriage gives unfair stuff to married people single people can't get and is thus a violation of the 14th amendment.

I can't be the only one who feels like talking to homophobes is akin to Whack-A-Mole. You trounce one of their idiotic arguments, and another comes along and makes the exact same argument.

But them viewing hetero depravity is ok? lol

Anti-obscenity laws will do that quite well, thank you. Unless you consider gays holding hands or kissing as "depravity".

two people are a group. Ergo you discriminate against 3 person groups by not granting them the same rights.
It's a bullshit argument.
Groups do not hav rights. Couples do not have rights. Individuals have rights, and gays have exactly the same rights as straight people. No difference at all.

As you well know, the restrictions on marriage have to meet constitutional muster. Interracial marriage bans restricted blacks and whites alike. But the restrictions themselves were unconstitutional. Gay marriage bans similarly don't meet constutional muster.

As court after court after court has found.

Well then you are shit outta luck. The SCOTUS has already ruled that homosexuals have the same rights to intimate contact and private sexual relations that straights do. You can bust them for nudity in public or sex in public, but two people holding hands or kissing is not illegal. And it also has nothing to do with same-sex marriage.

If the court said you should jump off a cliff does it make it ok to do it?
