You are absolutely right -- when circumstances allow. Those circumstances being a lack of clear and undeniable evidence useful to the prosecution.Any indictments will be overturned by a higher court. The police union is 100% on the side of their officers. They have unlimited financial and legal resources.

While the public is not yet aware of every item of evidence useful to the prosecution of these Baltimore cops, it appears to me the prosecutor is counting on testimony by one or more of them to identify the individual(s) who actually produced the injury that led to Gray's death. And faced with the choice of ten or more years in prison or dismissal of charges, that testimony will be readily forthcoming -- as it always is in such situations.
