Which is fine, given the fact the rights of the minority arent determined by majority rule, and the 14th Amendment applies the Federal Constitution to the states, including the Second Amendment.
The problem, as usual, is conservative inconsistency: if New York is overstepping its bounds by telling people what to do with their firearms, then the states are also overstepping their bounds by telling a woman whether she may have an abortion or not, or telling same-sex couples they may not marry.
Conservatives cant have it both ways just because they approve of guns but disapprove of privacy and equal protection rights.
But theres no right to privacy in the Constitution, its a made up right.
Theres no right to self-defense in the Constitution either, nor an individual right to own a handgun, are those made up rights as well?
Conservatives need to understand that the Constitution is not a cafeteria plan, they cant pick the rights they like and reject the rights they dont like. If New York gun laws are in violation of the Constitution, then so too is North Dakotas anti-abortion measure and Californias Proposition 8.
