The question remained whether the DoJ was acting properly when they did so.The FBI drops all charges but the judge wouldn't dismiss the case.
That's not true at all.President Trump gives Flynn a full pardon and the judge still would not let the case go.
That's because the judge would have had the option to appeal the case en banc and getting amicus briefs to see if that was a good idea or not. That's the system we have.A higher court ordered that judge to drop it...and he still wouldn't. So he opens the court to the public (amicus briefs) to see if anybody or their brother has anything against mike flynn.

Nope. Flynn's lawyers were working on behalf of Flynn. They had secured a deal that would keep Flynn out of jail entirely.Not much of a question when Flynns lawyers were acting on behalf of the crooked DOJ to obtain that plea. Which was discovered after he fired them.
Why wouldn't they?Why would an "impartial" judge ever wish to appeal a case?
