New York Attorney General Poised To Pounce On Trump Pardons

It sounds like a state AG doing his job, enforcing the laws of his state, ensuring that those who violate his state’s laws are brought to justice, consistent with the Constitution, due process, and the rule of law.

Actually, he wants to change the laws of his state, not enforce them.

I'm not saying that I'm opposed to his idea. But I'm opposed to your stupid explanation.

The lefts war on just law continues. What could possibly go wrong with ending double jeapordy protections?

It's not really doing that, though. Double jeopardy doesn't preclude a state prosecution for an action that has been pardoned at the federal level. This is a question of dual sovereignty and states rights.

As I shared in my he 9th circuit thread, we have several well paid and well orchestrated judges or AG of states that think THEY run the country
To try and mollify their clamours we have played along but the bomb is about to be dropped where we refuse, ignore and more forward with governing and improving America despite all the Sore Losers interference

Smart - Trump's pardon power could be abused to discourage co-operation with FBI.

Even if NY lawmakers will not change double-jeopardy laws, they would at least make it clear that Trump's pardons will not help on NY state level prosecution.

Actually, the way I understand it, if the person has either confessed to a federal crime or is convicted of a federal crime, at present in NY indicting once again on a state level would be considered double jeopardy.

Which is why the law needs to be changed. Trump sent a clear message with his pardon of Scooter Libby. If y'all be nice and don't implicate me, I'll pardon you.

New York Attorney General Eric Schneiderman has asked lawmakers to amend the state’s double jeopardy law so pardoned Trump aides could be held accountable for criminal activity.

“Presidents have used this power sparingly, largely to do justice, rather than subvert it,” Eric Schneiderman writes.

New York’s attorney general has asked officials to change state law so President Donald Trump’s aides can be tried for any criminal acts committed in the state, even if they have been given a presidential pardon.

In a letter sent to New York’s top lawmakers, including Democratic Gov. Andrew Cuomo, Attorney General Eric Schneiderman (D) said that he was troubled by Trump’s frequent discussion of his ability to issue pardons and that he was worried those who had committed crimes in the state would escape prosecution. New York has a double jeopardy law that prevents individuals from being charged with the same crime twice, even if the charges originated at the federal level.

“New York’s statutory protections could result in the unintended and unjust consequence of insulating someone pardoned for serious federal crimes from subsequent prosecution for state crimes,” Schneiderman wrote in the letter, dated April 18. “Even if that person was never tried or convicted in federal court, and never served a single day in federal prison.”

New York currently has 12 exceptions carved out of its double jeopardy law, and Schneiderman has proposed the pardon issue be carved out in a similar fashion. The Constitution protects against multiple prosecutions for the same offense, but only at the federal level.

“Since the Nation’s founding, presidents have used this power sparingly, largely to do justice, rather than subvert it,” Schneiderman writes in his letter. “Yet recent reports indicate that the President may be considering issuing pardons that may impede criminal investigations.”

And for you that process changes depending on who the target is....

Amend the double jeopardy law in N.Y. Are they going freaking crazy? God help us if Hillary won the election, angry democrat judges would be amending the rest of the Constitution

There are no Rights to a left winger...... they have power, and they will exercise it...if they have to pretend to follow the law they will, until it is no longer necessary or it gets in their way...

They want to amend it because New York has a much stricter "double jeopardy" law than the federal government, or that the US Constitution calls for. It bars charging somebody with a state crime that's similar to a federal crime, even if the person never faced actual "jeopardy"

They want to change when jeopardy attaches from indictment to trial, to match what the feds do.

The Double Jeopardy Clause of the Fifth Amendment to the United States Constitution provides: "[N]or shall any person be subject for the same offence to be twice put in jeopardy of life or limb..."

An indictment does not attach "jeopardy", a trial attaches "jeopardy"

The lefts war on just law continues. What could possibly go wrong with ending double jeapordy protections? Just keep prosecuting a case over and over until the defendant is bankrupt and can’t hire a lawyer or contradicts previous testimony in any way then get them for perjury.

The left won’t be happy until we have a system of law that looks like the Salem witch trials.

They did it 50 years ago in Dixie when they couldn't get a murder conviction they'd charge for "civil rights violation". This turd in New York can't change federal law if they intend to use a federal court and if they do that, Trump can pardon anybody he pleases....and that's the end of it.

Love it. Then we can go back all through past presidents and retroactively prosecute all of Obama and Clintons pardons to, as well as dubyas.
