The nonpartisan Congressional Research Service released a paper internally that suggests President Donald Trump may have the authority to use Department of Defense resources to build a border wall without obtaining congressional approval or declaring a state of emergency.

CRS, Congress’s in-house research arm, internally published a paper Jan. 10 titled “Can the Department of Defense Build the Border Wall?”

The Daily Caller News Foundation has obtained a copy of the paper.

The CRS document says (emphasis added):

“Another statute that authorizes the Secretary of Defense to assist civilian law enforcement with counterdrug activities may provide some authority for the construction of barriers along the border

“10 U.S.C. § 284 (Section 284) “10 U.S.C. § 284 (Section 284) provides that the Secretary of Defense ‘may provide support for the counterdrug activities or activities to counter transnational organized crime’ of any law enforcement agency, including through the ‘(c)onstruction of roads and fences and installation of lighting to block drug smuggling corridors across international boundaries of the United States.’

“Use of Section 284 would not require a declaration of a national emergency under the NEA.

“However, the DOD’s Section 284 authority to construct fences appears to extend only to ‘drug smuggling corridors,’ a condition that may limit where DOD could deploy fencing.”

I thought it was agreed that most of the illegal drugs and the plethora of opioids come in by air and sea. Seems like I read a few months back that China is a huge supplier of opioids. If this is true, a border wall would be a futile placement in the effort to stop an influx of illegal drugs when the national emergency is elsewhere. Same for those 4 duck-taped women in the back seat.

We have no common defense issue, we don't have a general defense clause, we have no wall building clause or immigration clause.

Where are they getting their supreme law of the land from?

The nonpartisan Congressional Research Service released a paper internally that suggests President Donald Trump may have the authority to use Department of Defense resources to build a border wall without obtaining congressional approval or declaring a state of emergency.

CRS, Congress’s in-house research arm, internally published a paper Jan. 10 titled “Can the Department of Defense Build the Border Wall?”

The Daily Caller News Foundation has obtained a copy of the paper.

The CRS document says (emphasis added):

“Another statute that authorizes the Secretary of Defense to assist civilian law enforcement with counterdrug activities may provide some authority for the construction of barriers along the border

“10 U.S.C. § 284 (Section 284) “10 U.S.C. § 284 (Section 284) provides that the Secretary of Defense ‘may provide support for the counterdrug activities or activities to counter transnational organized crime’ of any law enforcement agency, including through the ‘(c)onstruction of roads and fences and installation of lighting to block drug smuggling corridors across international boundaries of the United States.’

“Use of Section 284 would not require a declaration of a national emergency under the NEA.

“However, the DOD’s Section 284 authority to construct fences appears to extend only to ‘drug smuggling corridors,’ a condition that may limit where DOD could deploy fencing.”

“Drug corridors” are not defined in law, according to a congressional aide.....BUT it should be fairly easy to have border patrol IDENTIFY any area in which they have made a drug seizure in the last ddcace!!

Good catch by Rosiak. Nice to have the research with links to actual statutes.

Rosiak is basically an extension of Fox's Tucker Carlson so we can be confident that either Rosiak has been chosen by WH insiders to publicize this angle or through Carlson's contacts or via CRS, POTUS's lawyers have been briefed. Either way, we shouldn't necessarily expect a declaration of emergency or we shouldn't expect it to be the sole basis for putting the Army Corps of Engineers to work on the Wall.

If that is the case, why did the President make it clear yesterday that in three weeks he will use the national emergency option?
If it was well within his presidential powers, Trump would have done it a month ago and saved himself the aggravation

I just heard Ann Coulter angrily say that Trump 'wimped' on a promise he's been making for 18 months now. She is wrong! She is citing only half of his promise by not screeching over who pays for it. It's similar to overlooking the part of our defining document that states that 'all men are created equal' while importing kidnapped unpaid labor and keeping it illiterate and unable to organize. Half a promise just ain't good enough.
