Well, considering that the fetus doesn't have a heartbeat until around (again, an estimate, actual times may vary) 5 weeks (could be as soon as 4, or as late as 6), and then there's the whole brain argument.......the brain doesn't begin to form until around (estimated) the third week, and doesn't become an independent structure until around the ninth week.
