What is true is that one cannot breach a Non-Disclosure agreement unless there is something to disclose. Trump's lawyer are suing Stormy for 20 million dollars of breaching the NDA, which means that she is telling the truth. There may be a new ground for invalidating the NDA. The arbitration penalty is $1 million per disclosure, as an estimated harm done to Donald J. Trump as head of the Trump multi-billion enterprise. That a harm to his reputation as CEO of Trump inc, would cause the worth of Trump inc to suffer, and hence Trump to suffer economic loss.
Trump is no longer running Trump enterprises, he has no managing ties to the organization, and no effect upon it's operations. As Trumps reputation as president of the US, has no effect upon the worth of Trump inc, any statements made about Trump have no financial effect on his worth any more.
So the penalty of $1 million , may have been valid when Trump was CEO of Trump inc, that is no longer the case.

Washington (CNN)A new lawsuit filed by the porn star known as Stormy Daniels claims President Donald Trump never signed a hush agreement regarding an alleged sexual encounter between the two and therefore the agreement is void.
According to the legal complaint filed in California state court and tweeted out by her lawyer on Tuesday, Trump's personal lawyer, Michael Cohen, signed the document on behalf of the President instead.
The porn star, whose real name is Stephanie Clifford, claims in the lawsuit to have had an affair with Trump several years prior to his presidency. However, the lawsuit claims that when he was running for office and multiple women were coming forward to share stories of their own alleged encounters with the then-Republican presidential candidate, Cohen intervened in an attempt to keep Clifford from coming forward as well.
The lawsuit says Cohen has continued his attempts at silencing Clifford -- including as recently as February 27, 2018.

That is no longer the case. IN addition the damages are to be paid to David Dennison, who was not a signatory to the NDA.
