I don't think so. The agreement is between her and "EC, LLC and/or DAVID DENNISON, (DD)." It appears that EC is a shell company setup by Cohen, who did sign the agreement. And the agreement required either EC, DD, or both.

Seems to me, she's in violation of the contract.

• Cohen could seek damages if she is, but that's assigning culpability to Trump, validating her claims.

• Cohen could also provide a "DD" signed copy, claiming her copy was from before DD signed it, but again, that only validates her claims.

• If she's in violation, she could pony up the $1m penalty, but that too validates her claims and she'll be able to pay the $1m from the millions she makes selling her story.

• My guess is, the best thing trump can do is deny everything and forego the $1m penalty.
