I’m not sure how he is justifying 34 counts, but his explanation is that they paid monthly for the reimbursement of Cohen’s payments to the Newspaper as part of an effort to silence people with damaging potential information. Those payments were signed by Trump himself, and listed as legal fees on the books. If twelve payments were made, that would be twelve counts right there.

If you commit the same crime several times you aren’t risking double jeopardy.

It is said the Devil is in the details. You have to read to get the details. All I posted was the Statement of Facts submitted to the court to justify the indictment. The description of the crime if you will.

I have consistently said I don’t know. I don’t know if Trump is guilty. I don’t know if he is innocent. I don’t know enough to judge that. Literally all I know is what I read in the SOF which again, I posted as part of the thread. I have no idea what the Trump team will file in reply. I have faith that the system will work as it should.

The reason I have faith is that I believe in our Constitution. The Founders intended it to be hard to convict someone. I absolutely support that in every single case. I always have. I believe that the Defense, especially a well funded defense, tends to have the advantage. And again, I believe they should. Justice Blackwell said it was better for a thousand guilty men to go free than one innocent man be convicted.

I agree with that statement one hundred percent. It would not be possible for me to agree more.

But charges are not a conviction. Now the Defense gets their turn to make some arguments. They’ll read all the information that the indictment is based upon. They’ll read the grand jury record. They’ll read all the information, including any exculpatory information. They’ll be able to depose the witnesses, they’ll be able to research the law to determine the precedents that define what the law is.

The Defense may be able to get the charges dismissed, if the DA has overreached half as far as you folks who are certain you know the truth have been led to believer.

But let me say this. If the Prosecution lies, and all that. I’ll support a dismissal of all charges one hundred percent, just as I did in the Bundy case.

The problem with the argument that Trump did nothing wrong is a denial of the reality. There are literally millions of laws on the books. There are hundreds of thousands of laws on the books for guns alone. And if you look hard enough, you can find a violation of one of those laws, eventually. This is where Jury Nullification comes in. I suppose that is a subject of another thread someday.

We don’t know how the Defense will respond. I can tell you I hope it is a vigorous defense where every piece of evidence is challenged. Every witness is challenged, and defense experts are consulted and utilized.

But we have to wait and see. We have to drag the devil out into the light and see the details. Right now, we barely see the outline of the situation. It will likely take weeks, or months to get it all out in the light. When I hear more, when I read more, I’ll know more. If you are reading along with me, and many other moderates, who are fair and decent, then you’ll know more too.

Bragg is the beneficiary of “prosecutorial immunity.” No criminal charge applies to his actions and he (with very rare exceptions) isn’t subject to any lawsuit involving his personal liability.

But yes. He does reduce real felonies to misdemeanors. And is hostile to folks who defend their own property. He charges some of them with felonies.
