I’m not sure how he is justifying 34 counts, but his explanation is that they paid monthly for the reimbursement of Cohen’s payments to the Newspaper as part of an effort to silence people with damaging potential information. Those payments were signed by Trump himself, and listed as legal fees on the books. If twelve payments were made, that would be twelve counts right there.
