It has nothing to do with ideology. IF the gop makes up a new rule, it WILL EVENTUALLY come back to bite them on the ass. Politics is always about payback. That said, Justice Kennedy has always been a lock solid conservative vote on everything except gay stuff. But, being a conservative can also entail upholding the concept of Roe because it is settled law. When the dems confirmed Kennedy without any dissenting votes, they did so because they KNEW he was conservative and would come down on that side when issues were in doubt, but he was fair, committed to precedent and not a bomb thrower.

If Obama gives the gop someone along those lines, they'd be crazy not to confirm him/her because it is at best even money for them that Hillary will beat the Donald, and don't think for a second that she'll play nice.

What moronic right wingers fail to consider is WHAT Article 2 actually states regarding a SC nominee....

The Founders CLEARLY stated that it is up to the president...and NOT up to a referendum by the people....to nominate a justice....One would think that the wise Founders assumed that elections have consequences and that in a representative democracy, when a president is elected (for FOUR years, by the way) that individual assumes the responsibility of nominating someone.
