Then Trump should have refused his resignation and stood by Porter while he fought the charges in court.

He cant fight charges in court as he hasn’t been charged. Apparently that’s no longer necessary.

He could sue for defamation or some other such thing. He could have refused to step down, claiming his innocence and his desire to clear his name. Trump could have stood by him prior to him quitting, but he didn't.
