CNN Senior legal analyst, Elie Honig claimed that SCOTUS most likely would not make a ruling based on whether or not Trump committed insurrection, but said they would more than likely rule on whether states removing Him from their ballots was legal. You have to realize, these states would have to have standing to be heard. Virginia Dem Judge already tossed the ballot removal effort in that state, claiming the plaintiffs didn't show they had legal standing. That means they failed to show anyone was one was hurt or would be by Trump being on the ballot.

2 felony counts (including one conspiracy count) of obstructing an official proceeding under 18 U.S.C. § 1512

1 felony count of conspiracy against rights under 18 U.S.C. § 241

and the charges in Georgia are:

1 count of violating the Racketeer Influenced and Corrupt Organizations Act

1 count of conspiracy to commit impersonating a public officer

2 counts of conspiracy to commit forgery in the first degree

2 counts of false statements and writings

So you can see the charge of "insurrection" doesn't appear anywhere here. Rather, the insurrection occured as a result of Trump's coordinated, multi-pronged attack on our democracy.

Once Trump is finally convicted on all of these charges he will no doubt try to appeal each conviction all the way to The SCOTUS.
We'll see how that plays out.
So far Trump's defenses against these charges look pretty anemic so it's not looking good for him.
