The Supreme Court may have to decide on it, although they may not want to hear for various reasons (although I'm not not sure if the chances of that are that high).

It will easily pass if it does go up before the SC. Thomas has already hinted that the entire USSC is getting tired of the 9th throwing injunctions around at stuff that is clearly constitutional.

All people need do is look at the latest bill to see that any funding coming from congress for the wall will have to many anti-US strings. Its not a national emergency. But watch out, the Democrats may use the same tactic once they win the Presidency to declare a national emergency on "GUN CONTROL", or "CLIMATE CHANGE".
