There are these things called “elements” to that alleged crime. Where, as here, those “elements” are missing, well what you’ve got is a big empty bag of nothing.

Those "elements" are not required under the indictment at this point. I'm sure those elements will be part of the FDOTUS Team's motion to dismiss, the DA's team will then file a rebuttal, and then it will be up to the Judge.

It is possible, unlikely though, that the Judge will rule the connection from Business Record felony to Cohen's conviction of campaign finance violation to be tenuous and rule in favor or Trump.
