The underlying crime does not have to be prosecuted against Trump. There is no requirement under Section 175.10 that the person charged with that crime also be the person committing the crime that was being aided or attempted to conceal. That crime can be someone else (in this case Cohen) and it doesn't have to be a New York State crime (in Cohen's case crime was federal).
