The Constitution empowers the President to make an appointment. It also empowers the Senate to confirm or deny it. There is no “gentlemen’s agreement” between Dems and Republicans, and I could care less if there was.
There are indeed gentlemens agreements behind government. After all, the constitution gives no mechanism to impel congress to actually do anything for their salary. A congressman or senator, as long as they show up to be sworn in, can take the next 2 years as a paid vacation. Sloth is not an impeachable offense under the constitution, and neither congress as a body or a congressman as an individual can be compelled to do anything.

Seriously, there is no point in arguing about this. Either party will get a new Supreme whenever they have the Presidency and Senate regardless of the timing. If they don't have that, they can't do it. There is no "what's ethical?" there is only "what's Constitutional?"
